Realtor Statement

Dear Ladies and Gentlemen:

On behalf of the Santa California Subdivision, Units 14 and 15 Architectural Committee and Homeowners Association, dba Prado Valley One Homeowners Association (“Homeowners’ Association”), we are writing to request that you inform all prospective buyers of land in the Santa California Subdivision that, depending on the particular acreage they purchase, they will be required to adhere to the covenants governing such property. Please also provide these prospective purchasers with copies of the covenants that govern the property they are interested in purchasing.

The original covenants, established in the late 1960s and early 1970s, created Residential, Commercial, Apartment, Mobile Home, and Hospital/Medical Lots. In 1994, the covenants for all of the properties then owned by Anneliese Simpson and Jerome Willis were amended. Thus persons that bought property prior to 1994, when the amended covenants were filed, must comply with the original covenants. Likewise, persons who bought property after the amendments were filed must comply with the covenants filed in 1994. Additionally, on June 14, 2001, Gerald H. and Marylou Boise and a number of homeowners in Units 14 and 15 of the Santa California Subdivision entered into a settlement agreement that amended the restrictive covenant regarding mobile homes and made participation in and payment of dues to the Homeowners’ Association mandatory.  In July 2014 the PVOHOA covenants were again revised.  The 2014 Protective Covenants are available online at the Prado Valley One Homeowners Assoc. website.

Therefore, persons buying property owned by Mr. and/or Mrs. Boise and the above-referenced homeowners will need to comply with the amended language regarding mobile homes, and pay dues to the Homeowners Association.

The Prado Valley One Homeowners’ Association is an active group which is dedicated to maintaining the roads at a level that assists in making it safe to travel, enforcing the covenants, and working toward maintaining the architectural integrity of the area. Dues paid to the Homeowners’ Association pay for road maintenance, insurance, and administrative costs associated with these goals.

Dues are assessed annually at a rate of $225 for every land owner.  These dues are voluntary for landowners of Units 14 and/or 15 that did not sign the 2001 settlement agreement or purchased property in Units 14 and/or 15 from Mr. and/or Mrs. Boies prior to June 14, 2001.   

For landowners that executed the 2001 settlement agreement or purchased property in Units 14 and/or 15 from Mr. and Mrs. Boies after June 14, 2001, payment of dues is mandatory.  Additional fees and assessments may apply per the current PVOHOA membership dues rate structure.

For prospective buyers of property governed by the June 14, 2001 settlement agreement, we respectfully request that prorated dues be collected at the time of closing on behalf of the Homeowners’ Association.

The Homeowners’ Association welcomes all new owners and is requesting your help to make the Subdivision a comfortable, peaceful and aesthetic place to live by helping us increase knowledge and awareness of our covenants.

Prior to closing, realtors are required to submit a written request to the HOA Treasurer for outstanding property owner HOA fees and include an HOA Disclosure Certificate.

The “REALTORS ASSOCIATION OF NEW MEXICO HOMEOWNER’ ASSOCIATION (HOA) DOCUMENT AND DISCLOSURE CERTIFICATE REQUEST – 202X” form must be completed by the HOA and signed by both Seller and Buyer prior to closing.
